Nuisance claims can be split into either Public Nuisance or Private Nuisance.
Nuisance can take many forms for example:
- Damage to your property
- Noise
- Smells
- Leaks
- Interfering with your rights over land, such as overgrowing boundaries or access to land
Private nuisance is where those actions cause interference to an individual’s use or enjoyment of their land.
Public nuisance is where someone’s actions affect a number of people as a whole.
There are a variety of legal remedies for nuisances. These can range from claiming damages for losses you may have suffered to obtaining a Court Injunction which compels the person causing the problem to cease their nuisance actions.
